2. Second step (permanent visa): After holding a 188 visa and meeting the investment and residency requirements, you can apply for an 888 permanent visa.

⚠️ Important Policy Update: As of July 2024, the federal government has closed the application portal for all new 188 visa categories. Applicants should now focus on the potential alternative, the National Innovation Visa (NIV), which is designed for investors and entrepreneurs who can make significant contributions.

B. Required conditions for applicants

Requirements for the main categories of the original 188 visa (for reference to assess your own qualifications):

1. Business Innovation Stream (188A)

· Target audience: Small and medium-sized business owners
• Key requirements: Personal/business net assets of at least AUD 1.25 million; annual turnover of at least AUD 750,000; EOI score of 65 points; age under 55 (exemption possible).

2. Investor Flow (188B)

Suitable for: Investors in stocks, real estate, etc.
• Key requirements: Managing at least AUD 2.5 million in compliant investments; at least 3 years of investment experience; net assets of at least AUD 2.5 million; EOI score of 65 points; age under 55.
Investment allocation: AUD 500,000 in venture capital (VC) + AUD 750,000 in emerging companies + AUD 1,250,000 in balanced investments

3. Significant Investor Flows (188C) [Preferred by High Net Worth Individuals]

· Target audience: High-net-worth individuals
• Key requirements: Invest at least AUD 5 million in compliant funds; no age limit; no strict EOI scoring requirement.
Advantages: Relaxed residency requirements (main applicant only resided in the city for 160 days in 4 years), relatively flexible explanation of the source of funds.

4. Premium investor flow (188D)

· Target audience: Ultra-high net worth individuals
• Key requirements: Investment of at least AUD 15 million; nomination by Austrade required.

Other common requirements:

• State government nomination: You must first receive an invitation for nomination from the state or territory government.
• Medical examination and criminal record check: All applicants must meet health and character requirements.

C. Recommendation

1. Consider the alternative visa (NIV): With the closure of the 188 visa, the National Innovation Visa (NIV) is worth exploring. This visa is geared towards senior investors and entrepreneurs, placing greater emphasis on innovative backgrounds (such as green energy, digital technology, etc.) and substantial contributions to Australia. Traditional businesses (such as opening a coffee shop) are more difficult to obtain approval for.
2. Finding a Nominator and Professional Support: The NIV visa requires a respected nominator from the same industry. It is recommended to engage a professional agency to assist with qualification assessment, business plan preparation, and resource matching.
3. Prepare proof of assets: Regardless of the method used, complete proof of the source of funds (such as corporate audit reports, property appraisal reports, etc.) is required, which usually need to be traced back to the first pot of gold.
4. Consider other factors such as education: Although the investment immigration policy has changed, Australia's advantages in education and other areas remain. If the investment threshold increases, alternative pathways such as employer sponsorship and global talent programs can also be evaluated.

D. Australian Investor Visa Application Process (Taking the original 188 visa as an example for reference)

1. Self-assessment and document preparation: Assess net assets, company shares, etc., and prepare financial documents.
2. Submit EOI & Apply for State Nomination: Submit an Expression of Interest (EOI) through the USCIS SkillSelect system and apply for nomination from your desired state.
3. Receive an invitation and submit a visa application: After the state government approves the sponsorship, the immigration department will issue an invitation (valid for 60 days), within which you must submit a detailed visa application.
4. Medical Examination, Background Check, and Approval: Awaiting medical examination and criminal record check. Upon approval, you will receive a 188 temporary residence visa for up to 5 years.
5. Start-up Investment (Temporary Residence Stage): Land in Australia and complete the promised investment amount (such as AUD 2.5 million or AUD 5 million) within a specified time (usually within 2 years).
6. Apply for permanent residency (888 visa):
• 188B visa holders: must have held a temporary visa for 3-4 years, meet the required investment period, and have resided in Australia for 2 years.
• 188C holders: Maintain an investment of AUD 5 million for 4 years, and the main applicant must reside in Australia for at least 160 days.
